Washington Foreclosure Laws

Washington allows for both judicial and non-judicial foreclosures. Â Right of redemption is possible depending on the foreclosure process used. Â Generally it takes 120 days to foreclose, though this also varies depending on the foreclosure method.
Washington uses both deeds of trust and mortgages with some foreclosure methods permitting deficiency judgments.  Both deeds of trust and mortgages in default can be foreclosed on though either a judicial foreclosure or a non-judicial process.
Right of redemption is provided (within 8 days) during power of sale foreclosures and deficiency suits are prohibited in non-judicial foreclosures. Â They are permitted in judicial foreclosures unless the property has been abandoned at least 6 months prior to foreclosure.
